Terms of Use
Welcome to the Yichuda website (hereinafter: the "Website"). The Website is operated by the Yichuda Ila'a Association (Registered Association No. 580365773) (hereinafter: the "Website Management" or the "Company").
The Website serves as an educational and informational site and an e-commerce site which offers, among other things, various products for sale (hereinafter: the "Products").
- General
- These Terms apply equally to men and women alike; any use of the masculine form is for convenience only.
- The provisions of these Terms and the terms of use appearing on the Website define the legal relationship between the Customer and the Website, the terms of use of the Website and/or the ordering of Products from the Website, and attest to the Customer's agreement to these terms and to the additional terms appearing on the Website.
- The Company may update these Terms at any time, at its sole discretion.
- These terms apply to the use of the Website and the services included in it via any computer or other communication device (such as mobile phones, tablets, etc.). They likewise apply to the use of the Website whether via the Internet or via any other network or means of communication.
- Nothing in these Terms derogates from the provisions of the Consumer Protection Law, 5741-1981 (hereinafter: the "Consumer Protection Law") and the regulations enacted under it, to the extent that they apply to the Website (hereinafter: the "Provisions"), except in cases where such provisions may be contracted out of and such a stipulation was made within the Website, whether expressly or by implication.
- The Company and the Website Management do their best to present the most complete and comprehensive information about the Product, including pictures. Notwithstanding this section, it is clarified that inaccuracies and/or errors and/or omissions may appear on the Website in good faith, without malicious intent and/or any intent to mislead, and the Company, the Website Management, and the Website shall bear no liability arising from such inaccuracies and/or errors.
- The section headings are provided for the Customer's convenience and orientation and shall not be used in interpreting these Terms.
- A clerical error in the description of a product or products shall not bind the Company.
- Product images on the Website are shown for illustration purposes only. In addition, there may be differences in appearance, shade, size, and the like between the Product as shown on the Website and the actual Product.
- It is forbidden to copy or use, or to allow others to use, in any other way, content from the Website — including on other websites, in electronic publications, in print publications, and the like — for any other purpose.
- The time recorded in the Company's computer systems shall be the determining time for all purposes.
- Registration on the Website
- In order to place an order for Products, the Customer must register on the Website via an online registration form.
- Any person, including a company, may use the Website, including making purchases through the Website, subject, among other things, to being legally competent to perform binding legal acts and holding a valid credit card issued by a credit card company (above and hereinafter: the "Customer").
- Registration is required only once; the Customer will not be required to register again for each purchase.
- When registering on the Website, the Customer must enter a username and password as well as their email address. If the Customer forgets the password, the existing password as entered at the initial registration on the Website will be sent to the email address provided on the Website.
- In the future, if and when the Customer wishes to purchase additional Products, the Customer will be identified by the username and password they chose.
- The Customer's details will be updated according to the data filled in by the Customer in the online registration form available on the Website.
- The Website Management may from time to time require additional identifying details.
- Without derogating from the above, the Company may prevent any person from using the Website, temporarily or permanently, at its sole discretion and without prior notice, including in any of the following cases:
- Committing an unlawful act and/or violating the provisions of the law;
- Breaching any condition of these Terms;
- Deliberately providing false details;
- Performing an act liable to harm the proper operation of the Website and/or any of the suppliers and/or any third party;
- The credit card in the Customer's possession has been blocked or restricted from use in some way.
- Purchasing Products on the Website
- Products are purchased by adding Products to the shopping cart. After adding Products to the cart, the Customer will enter, in the designated online form during the ordering process, the following Customer details: first name, last name, phone number, and email address. In addition, the order recipient's details must be provided: first name, last name, phone number, town, street, house number, floor, apartment, entrance, and any other identifying detail that can help the courier easily locate the property to which the order is being delivered, including notes and information regarding the delivery and/or for cases where the order recipient is not at home. Fields marked with an asterisk are mandatory, and without them the order cannot be completed.
- To prevent any possibility of a delivery problem, the Customer must provide only accurate and correct details.
- When completing the order, the Customer will confirm the order details and the correctness of the details provided.
- Filling in all the details is a precondition for placing the order, so that the Order can be processed efficiently and without issues; therefore, care must be taken to provide all details accurately.
- The Customer's details will be updated in accordance with the online order form on the Website.
- Once the Customer has filled in all the details required to purchase the Product, this will be considered the placing of an order (hereinafter: the "Order"). Upon receipt of the Order, the Website will check the credit card details, and only after approval by the credit card company and/or after receiving approval from PayPal, as clarified below, will the transaction be approved and a final confirmation of the Order issued. The Customer will be charged for the Product via the credit card and/or via the PayPal account, as explained below — all subject to the Products being in stock with the Company and the Website.
- The details entered by the Customer in the order form will constitute conclusive evidence of the correctness of the actions performed.
- It is a condition of purchasing on the Website that the purchaser is 18 years of age or older.
- Payment for the Order
- Payment for the Products is made by credit card or via an account with an "electronic wallet" service such as PayPal (www.paypal.com) or any similar service, as available for use on the Website from time to time at the discretion of the Website Management.
- If the Customer chooses to use a credit card to make the payment, the Customer will be asked to provide the credit card details, ID number, card type, and expiration date. If the Customer decides to pay via PayPal, the Company will be able to collect payment for the Products only after receiving approval from PayPal. The use of PayPal and the receipt of its approval are subject to the terms of use of the PayPal website.
- The Website Management reserves the right to discontinue the use of any payment method on the Website, to allow the use of additional payment methods, and to apply different payment arrangements to different types of credit cards or payment methods that the Website Management honors.
- After the payment details have been entered in the online order form, a confirmation that the Order details have been received will be sent to the Customer by email. It is clarified that this confirmation does not obligate the Website Management to supply the ordered Products; it only indicates that the Order details have been received by the Website Management.
- Immediately after the Order is placed, the Website Management will check the payment method used by the Customer, an appropriate notice will be given to the Customer that the Order has been approved, and their account will be charged for the cost of the service.
- If the transaction is not approved by the credit card company, by PayPal, or by any other payment method available at the time, the Customer will receive an appropriate notice, and the Website Management will contact the Customer in order to complete or cancel the transaction.
- Approval of the purchase is conditional on the purchased Product being in stock on the requested delivery date and/or on the Order date. If it was not stated that the Product is out of stock and the Product was not removed from the Website by the time the Order was placed, the Website Management will not be bound by the sale, provided that it refunds the Customer any amount paid to it, if paid, and/or cancels the charge for the purchase, if made.
- It is clarified that there may be situations in which, even though an item is shown on the Website as being in stock, it is in fact out of stock and cannot be supplied. In such cases the transaction will be canceled, and the Customer shall have no claim in that regard, subject to the refund of the amount paid by the Customer.
- The delivery date will be set starting from the day the transaction is approved by the credit card company, or approval is received from the PayPal account or from another approved available electronic wallet service.
- If the Customer is charged in error by the credit card company, the Customer must notify the Website Management so that a corresponding credit can be issued.
- Supply and delivery of the Products
- The Product will be supplied by the Website only after payment confirmation is received from the credit card company and/or from the PayPal account — that is, once the Product has been paid for, as detailed above. The Product will be delivered to the address the Customer typed and/or provided in the online form when placing the Order.
- The Website undertakes to supply the goods within the delivery time frame to the requested destination and will do its best to ensure that the Product arrives quickly.
- The Website Management will do its best to supply the Products quickly, within 21 business days from the day the Order is received and approved; Products are sent by registered mail.
- Product delivery times are calculated in business days only (Sunday through Thursday, not including Fridays, Saturdays, holiday eves, and holidays).
- Deliveries made via the delivery company on behalf of the Website Management are subject to the delivery company's terms and distribution zones, and are coordinated in advance with the order recipient.
- If the delivery company is unable to deliver to the shipping address for any reason, the Website Management will notify the Customer and will work to find an alternative solution that satisfies both parties.
- In cases where the Products are supplied via Israel Post, to the shipping address the Customer provided when placing the Order, the Products will be sent subject to Israel Post's delivery times, which cannot be monitored or controlled by the Website Management and/or the suppliers.
- The delivery times stated on the Website and above do not apply to Products that are out of stock on the Website and/or out of stock at the relevant supplier.
- Deliveries are carried out by a courier company; the courier company's terms will bind the Customer.
- Shipping fees — in addition to the price of the ordered Products, the Customer will be charged a shipping fee. The shipping fee amount will appear at the end of the ordering process according to the shipping method the Customer chose, unless stated otherwise.
- The shipping fee is paid together with the payment for the Product. In an installment sale via credit card and/or a PayPal account, the Website may collect the shipping fee together with the first installment.
- The Website shall not be liable for any delay and/or holdup in delivery and/or non-delivery of the Products caused by any of the following:
- Force majeure — and without derogating from the generality of the foregoing: war, military operation, state of emergency and/or natural disasters and/or events beyond the Website's control such as economy-wide strikes and lockouts and/or strikes at suppliers of services or goods needed for production, supply, or transport of a product.
- Any cause beyond the control of the Website and/or the Company.
- A cause connected with the party carrying out the delivery.
- The stated Product delivery times are calculated in business days only (Sunday through Thursday, not including Fridays and Saturdays, holiday eves, and holidays).
- The Customer must immediately notify the Website if the Product was not delivered within the delivery period stated on the Website; in such a case, the new delivery time will be counted from the day a new date is coordinated.
- Care must be taken to fill in accurate and up-to-date details. If the Products are returned to the Company because of incorrect details, the Customer will bear the shipping and handling charges.
- Cancellation of a purchase by the Customer
- The Customer may cancel the transaction in accordance with the provisions of the Consumer Protection Law and the regulations enacted under it. Without derogating from the foregoing:
- Cancellation must be made only within 24 hours of the time of purchase, by written notice to the email address yichuda@gmail.com.
- Cancellation of a transaction by the Customer will not be possible for the purchase of certain items, as detailed in subsection 14C(d) of the Consumer Protection Law.
- Cancellation of the transaction by the Customer is subject to the Product being returned, to the extent reasonable or possible, in its original packaging.
- After the cancellation notice is received, the amount the Customer paid for the Product will be refunded, less a cancellation fee of 5% of the transaction amount or 100 NIS, whichever is lower (shipping fees are not part of the Product price and will therefore be deducted separately from the refund). In the case of a cancellation due to a defect or non-conformity, the Customer will not be charged any cancellation fee. Additional provisions of the Consumer Protection Law regarding cancellation of the purchase by the Customer, including regarding the obligation to return the Product, will apply as well.
- The Customer may cancel the transaction in accordance with the provisions of the Consumer Protection Law and the regulations enacted under it. Without derogating from the foregoing:
- Cancellation of a purchase by the Company
- The Company may, at its sole discretion, for any reason, and at any time, cancel or discontinue a transaction and/or sale and/or cancel an Order, in whole or in part, and/or the operation of the Website, in whole or in part.
- Notice of such a cancellation or discontinuation will be given to the user or the Customer, and the Company will refrain from charging the Customer's credit card or will refund any amount paid for the Products, to the extent paid.
- Except for the refund of the transaction amount as stated, the user or the Customer shall have no claim, suit, and/or demand against the Company and/or the supplier for the cancellation of the transaction as described in this section.
- If it is discovered that a Product is out of stock, the Website may cancel the Order or offer an equivalent alternative item. If an Order is canceled as stated, the Website shall not be liable for, and shall not bear, any direct, indirect, consequential, or special damage caused to the Customer or to a third party, including, but not limited to, damage arising from the purchase of the item from a third party at a higher price.
- Copyright
- All intellectual property rights, including patents, copyrights, models, registered designs, and trade secrets, are the property of the Company alone or of other third parties that have permitted the Website Management to use them.
- These rights apply, among other things, to the data on the Website, including the list of Products, the description and design of the Products, and any other detail related to its operation.
- These rights also apply to the Website's name and the Website's domain name (www.—–.com); the trademarks (whether registered or not) are all the property of the Company. They may not be used without its prior written consent.
- It is forbidden to copy, duplicate, distribute, sell, market, rent, or translate any information from the Website, including trademarks, images and texts, product designs, product images, and the like, without the prior written approval of the Company.
- It is forbidden to link to content on the Website other than the Website's home page (deep linking), or to display or publish such content in any way, unless the deep link is to the full web page on the Website as it is, so that it can be viewed and used in a manner completely identical to viewing and using it on the Website — and only with the consent of the Website Management.
- The Website Management may order the removal of a deep link even after having given its consent, at its sole discretion, and in such a case you shall have no claim and/or demand and/or suit against the Website Management.
- Liability
- The Company (and/or anyone on its behalf) bears no liability whatsoever, directly and/or indirectly, for damages arising from and/or connected in any way with the repair, assembly, and/or replacement of the Products.
- The Company (and/or anyone on its behalf) bears no liability whatsoever, directly or indirectly, for damages resulting from the use of and/or reliance on information published on external websites that can be reached through any of the services on the Website. It is clarified that the Company does and will do its best to work only with reliable, reputable suppliers.
- The Company (and/or anyone on its behalf) bears no liability whatsoever, directly and/or indirectly, for damages arising from and/or connected in any way with the use and/or performance of the Website.
- In any event, the Company shall not be liable for any activity of any other party that is not under its full control.
- Confidentiality and Privacy
- All of the Customer's personal details (name, email, and so on) will be stored in the Company's databases.
- The Company will not transfer the Customer's personal details to any other party except to suppliers, as needed, and only in order to complete a transaction.
- The Company will make no use of the details of the Customer's payment method except to process payment for a transaction the Customer asked to make, and these details will not be transferred to any other party except for this purpose. For the avoidance of doubt, payment method details are not stored in the Company's databases.
- Notwithstanding the above, the Company may transfer a user's personal details to a third party in cases where the Customer committed an act or omission that harms and/or may harm the Company and/or any third parties, the Customer used the Company's services to commit an unlawful act, the Company received a judicial order instructing it to hand over the Customer's details to a third party, and in any dispute or legal proceedings.
- The Company may use the Customer's personal details, without identifying the specific Customer, for the purpose of analyzing statistical information and presenting it and/or providing it to other parties.
- Since these actions are performed in an online environment, the Company cannot guarantee absolute immunity against intrusions into its computers or exposure of the stored information by those committing unlawful acts. If a third party succeeds in gaining unauthorized access to information held by the Company and/or in misusing it, the user shall have no claim, suit, or demand against the Company.
- The Company may use "cookies" in order to provide the user with fast, efficient service and to spare the Customer the need to enter their personal details on each visit to the Website.
- In cases beyond the Company's control and/or arising from force majeure, the Company shall not be liable for any damage of any kind, indirect or direct, caused to the Customer and/or anyone on the Customer's behalf if this information is lost or used without authorization.
- Governing Law and Jurisdiction
- The law governing these Terms and/or any action and/or any dispute arising from them is Israeli law only.
- In any case of dispute, the courts (Magistrates' or District) of Tel Aviv-Jaffa shall have exclusive jurisdiction to hear it.
- The law governing the use of the Website, the Order, and these Terms, including the interpretation and enforcement of these Terms, is Israeli law only.
